Jdigital agrees with Spain’s Royal Decree
Jdigital discussed the Royal Decree published by the DGOJ this week, which will regulate the gambling publicity and set stricter measures.
Spain.- The General Directorate of Game Management (DGOJ) shared this week the Royal Decree that will regulate the gaming industry in Spain. After the release of the Royal Decree draft, Jdigital gave an opinion on the matter and assured that it agrees with several of the measures presented.
However, they said in relation to the scope of the measures proposed by the Ministry of Consumption, they believe that the will is that they’ll apply in the same way to the public game as to the private one. Otherwise, a differentiated treatment would generate a situation of unfair competition for private online gambling companies, as the CNMC or the European Commission has reiterated.
“Some of the restrictions are, in any case, disproportionate, such as the prohibition of communicating prices (quotes) in the objective and neutral commercial communication itself, being an information right – fundamental and constitutional.”
“In short, we hope that the Government can regulate and continue with its plans so that, with logical and proportional criteria, we will bring negative externalities to zero in a sector that generates employment, economy and that represents a healthy and legal leisure alternative for many users.”
“Finally, on the hourly restriction of the advertisements, we consider that some of the measures proposed imply a disguised prohibition of online game advertising. Regulated advertising is the tool for differentiating legal operators from illegal ones,” they concluded.
