Arkansas Commission urged to issue casino licences

A company has demanded the Arkansas Racing Commision to comply with a recently passed amendment and issue four casino licences.

US.- Gulfside Casino Partnership LLC has urged the Arkansas Racing Commission (ARC) to get in line with a recently passed amendment in order not to be in breach of the state constitution. The company is looking to develop one of the four casinos for which the regulator has to issue the licences.

According to the company, ARC would breach the state constitution should it not issue said licences. Therefore, they’d be cleared to sue in case the racing commission’s draft rules on the casino industry get approved.

Gulfside has addressed a rule that sets the requirement for officials to endorse casino proposals at the time operators file the respective application. Since they want to build a US$254 million hotel and casino in Russellville, but received endorsements from former officials in November, which means potential ARC rules would invalidate them.

“Any rule promulgated by the Racing Commission which results in the issuance of less than four casino licenses is in direct conflict with Amendment 100 and is, therefore, unconstitutional,” said Casey Castleberry, Gulfside’s attorney.
