US casino’s bid to recoup $1.1m in overpaid taxes denied

The casino operator claimed it had overpaid taxes on slot machine revenue for a period of two years.

US.- The Pennsylvania state Supreme Court has rejected a bid from Greenwood Gaming and Entertainment to recover $1.1 million in overpaid taxes.

The casino operator claimed it had overpaid taxes on slot machine revenue for a period from January 1 2009 until January 4 2011.

Greenwood requested credit for the amount overpaid, rather than a refund.

But the Pennsylvania Supreme Court upheld a lower court ruling from 2019, which found that the request for a tax rebate had come six months too late.

The company’s request was filed in June 2014 but there is a three-year limit for refund requests after the date in which the payment was made.

Greenwood’s lawyers argued that the company had missed the deadline because it was applying for credit rather than a refund.

The state of Pennsylvania has lost out a huge amount of tax revenue from casino operators as a result of the novel coronavirus outbreak.
