Brazil to require stricter age verification for online gambling

A new decree on age verification requirements is expected by the end of the month.

Brazil.- The federal government of Brazil is finalising a decree that would aims to tighten measures to prevent children and adolescents from accessing gambling, pornography and other content considered inappropriate. The legislation should be published by the end of February and would implement regulations approved in 2025 that require digital platforms and application stores to adopt identity verification systems.

According to O Globo, sites and applications that offer or promote betting, adult content, escort services, alcoholic beverages, relationship applications and weapons would have to verify users identities. The plan is that the government will create is own age-verification system that websites could use. Self-declarations of age would not be acceptable.

The decree is also expected to outline safeguards for the protection of personal data, with restrictions on identity tracking, browsing history and rules of handling user requests. The text may still undergo adjustments, pending the government of President Luiz Inácio Lula da Silva.

Despite the resistance of opposition parliamentarians, who allege the risk of censorship, the Supreme Federal Court decided last year in favour of greater responsibility for digital platforms.

Consultation on the regulation of betting suppliers

Meanwhile, the Ministry of Finance, through the Secretariat of Prizes and Betting (SPA), has announced a public consultation on the regulation of service providers for fixed-odds betting in Brazil. The consultation period will run from February 4 to March 23. Any individual or legal entity can participate through the Brasil Participativo Portal.

The measure aims to support the drafting of the Ordinance on the Recognition of Operational Capacity, which will define technical and operational criteria for suppliers working with regulated betting operators in Brazil. Submissions will be analysed by the SPA under legislation, including Law No. 13,756/2018, Law No. 14,790/2023 and Decree No. 12,002/2024.
