Guinea’s Gaming Regulator faces CNT backlash over ‘inadmissible’ tax letter

The National Transitional Council (CNT) has condemned ARSJPA’s directive to gambling operators, highlighting legal violations.

Guinea.- The National Transitional Council (CNT) of Guinea has publicly condemned a letter from the Director General of the Gaming and Related Practices Regulatory Authority (ARSJPA), describing it as “inadmissible”. The letter, dated February 4, 2025 (Letter No. 0024/ARSJPA/DG/2025), instructed gambling operators not to pay legally mandated taxes, triggering a strong backlash from the country’s legislative body in November 2025.

The CNT, Guinea’s temporary legislative body during the transitional period, acts like a parliament, reviewing laws, overseeing government agencies and monitoring compliance in key sectors such as gaming. Its oversight powers became particularly important during the review of Guinea’s 2025 supplementary budget law.

During this review, the CNT emphasised the application of the two categories of levies established under the Initial Finance Law 2025: a 15 per cent tax on gross gaming revenue and a 7 per cent levy on Non-Commercial Profits (BNC) for winnings exceeding GNF1m (€90).

CNT rebukes ARSJPA for defying tax law

The Council claims that ARSJPA instructed operators “to refuse to pay these legally established taxes”, according to a Guinee114.com report.

CNT said: “In other words, an administrative service opposed the application of a law duly proposed by the Government, adopted by Parliament and promulgated by the President of the Republic, without any legal basis whatsoever.”

The Council described ARSJPA’s actions as contravening “the principle of the hierarchy of norms and the obligation of all state bodies to respect the law.” The Council called on the Prime Minister to ensure these tax measures are implemented in accordance with the Finance Law.

CNT also highlighted a legal inconsistency concerning ARSJPA’s status. While Law 08 of March 13, 2023, establishes the authority as an Independent Administrative Authority (AAI), Decree 045 of January 28, 2023, grants it the status of a public administrative body, creating a conflict between statutory law and executive decree. The CNT recommended repealing the decree and aligning ARSJPA’s framework with Law 08.
