New Mexico files lawsuit against Kalshi

The lawsuit alleges that the operator is unlawfully offering online sports betting in the state.

US.- New Mexico Attorney General Raúl Torrez has announced that the New Mexico Department of Justice (NMDOJ) has filed a lawsuit against Kalshi and KalshiEX. The lawsuit alleges that the prediction platform is unlawfully offering online sports betting in the state while attempting to evade the state’s licensing and regulatory requirements

The state argues that the platform allows users to wager on the outcomes of sporting events through event contracts similar to traditional sports bets and offered its product to New Mexico residents without obtaining a gaming licence. The lawsuit algo claims that Kalshi has allowed participation by people aged 18 to 20, despite New Mexico’s minimum gaming age of 21.

Torrez said: “New Mexico has a longstanding and carefully balanced system for regulating gaming that protects consumers, ensures accountability, and respects tribal sovereignty. The only lawful gaming in New Mexico operates either under tribal-state gaming compacts, or under strict state regulations to ensure honest gaming free from corruption, and licenses gaming operators only after they explain how they plan to address compulsive gambling. Kalshi has ignored that framework entirely while offering online sports betting within the state. We are filing this lawsuit to protect the integrity of our laws, our regulatory system, and most importantly, consumers.”

The Nevada Gaming Control Board (NGCB) recently won its motion for a preliminary injunction against the prediction platform Polymarket. Chairman Mike Dreitzer welcomed the ruling and said the regulator would “continue to vigorously enforce Nevada law to safeguard gaming in our state.”

The NGCB said it has taken action to restrict all unlicensed prediction market operations that were known to be operating in the state. Previous preliminary injunction orders prohibited Kalshi and Coinbase from offering or facilitating event contracts in Nevada related to sports, elections and entertainment.
