Minnesota Supreme Court allows Running Aces casino to keep ETGs

The Shakopee Mdewakanton Sioux Community had argued that the ETGs violated tribal exclusivity.

US.- Running Aces Casino, Hotel & Racetrack can keep its allowance of a new dealer table and 11 player stations for electronic table games. The Minnesota Supreme Court has decided to leave in place a previous Court of Appeals decision that upheld the Minnesota Racing Commission’s (MRC) approval. There were three votes in favour, three against and one abstention.

The Minnesota Racing Commission (MRC) approved the plan for the card club run by Running Aces back in 2023. However, the Shakopee Mdewakanton Sioux Community filed a lawsuit arguing that the ETGs are electronic games of chance covered by its tribal compact and thus violate tribal exclusivity.

The Minnesota Court of Appeals concluded that the MRC had not acted unlawfully or exceeded its authority when it approved the 2023 amendment.
