Gibraltar Gambling Act 2025 enters force
The new legislation demands that licensed operators have a substantive economic presence in Gibraltar.
Gibraltar.- The Gibraltar Gambling Act 2025 has come into effect, replacing legislation from 20 years ago. the new act puts new business categories under the supervision of the act and the Gambling Gambling Division of the Ministry of Finance, which is led by Andrew Lyman.
Gambling licensees must now demonstrate a substantive economic presence in Gibraltar, which can be through through offices and infrastructure, employees and their local tax contribution. This change aims to eliminate so-called “brass plate” operations that had no real presence in the territory.
The new gambling legislation introduces separate licences for B2C, B2B and gaming operator support services. Marketing and CRM, managed trading and software hosting require approvals. Meanwhile senior staff will have to undergo personal vetting to ensure accountabilty. This will be similar to the Gambling Commission’s Personal Management Licences in Britain.
Marketing activities will be subject to new regulations, and the Gambling Commissioner will be able to issue administrative fines, cease-and-desist orders and suspensions. Operators will also need to make more digtial reports, including on AML compliances, technical standards and safer gambling measures.
A Gambling Appeals Tribunal will be introduced as an independent body that will hear appeals against decisions made by the Gambling Commissioner, including on licence refusals, suspensions and revocations.
