DraftKings challenges Interactive Games patent over mobile wagering technology
The sportsbook operator has asked the Patent Trial and Appeal Board to invalidate a patent covering location-based authorisation for mobile wagering.
US.- DraftKings has asked the US Patent Trial and Appeal Board (PTAB) to invalidate Interactive Games LLC‘s US Patent No. 12,406,284. The patent covers a mobile wagering system using location data to determine where betting is permitted. The petition was filed on September 17 and challenges all 18 claims of the patent.
Titled Mobile device proximity tracking for selective content delivery and formatting, the patent describes a system that uses a device’s location to authorise betting only within permitted areas. It also covers the delivery and formatting of wagering and promotional content on the mobile device. DraftKings argues that the technology described was already known before its filing.
The patent is one of five at the centre of a lawsuit filed against DraftKings in Massachusetts in April. Interactive Games, a successor to Cantor Gaming, alleges that DraftKings’ mobile applications infringe the patents, including technology related to geolocation and mobile wagering.
The patent lists US Commerce Secretary Howard Lutnick as its lead inventor from his time at Cantor, according to reporting on the PTAB filing. Interactive Games previously brought disputes involving DraftKings and FanDuel before the PTAB over other patents. The new proceeding, DK Crown Holdings Inc. v. Interactive Games LLC, remains pending.
