Proposed Criminal Code amendments would introduce income-based fines, longer prison terms for repeat offenders, and stricter sanctions for crimes involving minors or organised groups.

Azerbaijan.- A bill that proposes stronger criminal penalties for organising and operating illegal gambling in Azerbaijan has passed its first reading. The legislative package, discussed during an extraordinary session of the National Assembly, proposes amendments to the country’s Criminal Code aimed at addressing illegal online gambling.

One of the key changes proposed relates to the way financial penalties would be calculated. Instead of the current fixed fines of AZN 10,000 (US$5,880) to AZN 15,000 (US$8,800), courts would be able to impose fines of up to twice the proceeds obtained from the illegal activity. Punishments could also include restrictions on their liberty for two to four years, or imprisonment for the same period.

The draft legislation would introduce tougher penalties for repeat offenders. Under the current Criminal Code, repeated gambling-related offences can result in restriction of liberty for four to five years or imprisonment for four to eight years. If the amendments are approved, repeat offences would carry mandatory prison sentences of five to eight years.

The bill will continue through the country’s legislative process.
