Researchers and lawmakers caution that key elements of the framework could be easily circumvented, particularly when it comes to podcasts, social media and influencer-driven content.

The reform, backed by Prime Minister Anthony Albanese’s government, introduces a so-called “triple lock” mechanism aimed at reducing exposure to wagering ads. Under the plan, streaming platforms, search engines and websites hosting betting-related content would be required to ensure users are logged in, verify they are over 18 and provide an option to opt out of gambling advertising.

While the government argues the system will protect minors and give adults greater control, critics say it leaves significant regulatory gaps. Researchers and independent politicians note that podcasts and influencer marketing often have advertising embedded directly into content, making it difficult to regulate.

Independent senator David Pocock described the current proposal as “almost unworkable,” arguing that the gambling industry would adapt to new channels. “This predatory industry innovates and pivots quickly to target new mediums and markets,” he said, pointing to a growing presence of gambling promotions in popular podcasts and online content.

Independent MP Kate Chaney criticised the reliance on an opt-out model, warning that it places too much responsibility on users. She noted that families would need to manually adjust settings across multiple platforms to avoid exposure and argues that there is little evidence that such measures effectively reduce gambling-related harm.

Communications Minister Anika Wells has defended the reform, stating it aims to “break the connection between wagering and sport” and reduce the overall saturation of gambling ads across media channels. Government representatives have indicated that more precise definitions will be included during the legislative drafting process to address potential loopholes.

Early assessments suggest the impact on the industry may be modest. A report from the government’s Office of Impact Analysis estimates the measures could reduce annual gambling expenditure by AU$62.7m (US$43.5m), or just 0.8 per cent.

   See also:

See also: Australia’s gambling ad reforms to cut spending by just 0.8%, government analysis shows

Australia's proposed "triple lock" gambling advertising reforms, backed by Prime Minister Albanese's government, face significant criticism from lawmakers and researchers who argue the system is easily circumvented by new media channels like podcasts and influencer content.
