{"id":22297,"date":"2021-09-03T13:23:39","date_gmt":"2021-09-03T16:23:39","guid":{"rendered":"https:\/\/focusgn.com\/asia-pacific\/?p=22297"},"modified":"2026-04-23T16:00:52","modified_gmt":"2026-04-23T19:00:52","slug":"imperial-pacific-fails-to-make-august-settlement-payment","status":"publish","type":"post","link":"https:\/\/focusgn.com\/asia-pacific\/imperial-pacific-fails-to-make-august-settlement-payment","title":{"rendered":"Imperial Pacific fails to make August settlement payment"},"content":{"rendered":"\n<p>Imperial Pacific has failed to comply with its scheduled settlement payment for August.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p>Northern Mariana Islands.-<strong>\u00a0Xerox has asked the Federal Court to lift a 30-day automatic suspension of proceedings\u00a0<\/strong>and to\u00a0<strong>enforce a judgment on IPI\u2019s failure<\/strong>\u00a0to make a settled payment last month.<\/p>\n\n\n\n<p>The court had issued an order to pay monthly instalments of $10,000 towards an outstanding $210,773.11.\u00a0According to attorney Richard Miller, <strong>IPI failed to make the first payment<\/strong>.<\/p>\n\n\n\n<p>According to the agreement, if IPI failed to pay by the 21st of the month, then the unpaid balance of the judgment amount would immediately become due. If failure to correct the default continued to the 30th,<strong>\u00a0Xerox could file a motion for an order to show cause.<\/strong><\/p>\n\n\n\n<p>According to the Saipan Tribune, the entire balance on the amended judgment became immediately due as\u00a0<strong>IPI didn&#8217;t pay before August 21<\/strong>.<\/p>\n\n\n\n<p>Attorney Richard Miller stated: \u201cIPI made only one payment of $10,000, in July 2021, and since then has made no payment to satisfy the amended judgment.\u00a0Because it is now past the 21st of that month and IPI has not cured the default, the entire balance is immediately due and payable.&#8221;<\/p>\n\n\n\n<p>In August,\u00a0<strong>South Pacific Lumber Company\u00a0<\/strong>sued <a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/focusgn.com\/asia-pacific\/ipi-sued-for-failing-to-pay-rent-on-warehouse\">IPI<\/a>\u00a0for non-payment of rent on commercial warehouse space. According to<strong>\u00a0James Whang<\/strong>, of South Pacific Lumber Company,\u00a0<strong>IPI stopped paying the rent in March 2020<\/strong>. He has asked the court to issue an order evicting IPI from the property.<\/p>\n\n\n\n<p>He also wants<strong>&nbsp;injunctive reliefs to preserve IPI\u2019s assets&nbsp;<\/strong>inside the warehouse to ensure payment of the judgment entered in the case. The company\u2019s attorneys are&nbsp;<strong>seeking a payment of $391,703.13<\/strong>&nbsp;\u2013 $276,080 for rent, $110,432 for late fees, and $5,191.13 for utilities.<\/p>\n\n\n\n<p>IPI first leased the warehouse for a one-year period starting on May 11, 2015. Both parties agreed to extend the lease to May 10, 2021.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Former IPI chairwoman in contempt of court again<\/h2>\n\n\n\n<p><strong>Cui Li Jie, former IPI chairwoman<\/strong> has been found to have<strong>\u00a0breached a court preservation order\u00a0<\/strong>that obliged her to keep data from her mobile phone. <a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/focusgn.com\/asia-pacific\/former-ipi-chairwoman-accused-of-failing-to-comply-with-court-order\">Attorney Aaron Halegua<\/a>, who represents seven Chinese construction workers suing IPI, had\u00a0<strong>accused Cui Li Jie of obstructing the case<\/strong>.<\/p>\n\n\n\n<p><strong>NMI Chief Judge Ramona V. Manglona\u00a0<\/strong>ruled that the court \u201cfound that Cui blatantly disregarded the court\u2019s order by continuously deleting her WeChat messages even though the court\u2019s preservation order required that she preserve all\u00a0<strong>electronically stored information (ESI)<\/strong>\u00a0data.\u201d<\/p>\n\n\n\n<p>According to Saipan Tribune,\u00a0<strong>Cui Li Jie was asked to provide her computer for forensic analysis<\/strong>.\u00a0She was also ordered to submit an amended sworn statement describing all ESI data within five days, to<strong>\u00a0provide proof of purchase for the rose gold iPhone she recently brought<\/strong>, and to provide all remaining SIM cards she has in her possession.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Imperial Pacific has failed to comply with its scheduled settlement payment for August.<\/p>\n","protected":false},"author":176,"featured_media":18727,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"is_press_release":false,"is_interview":false,"is_opinion":false,"focusai_summary":"Imperial Pacific International (IPI) has defaulted on a scheduled settlement payment to Xerox and faces eviction proceedings from South Pacific Lumber Company for unpaid rent.
