{"id":20661,"date":"2021-07-26T16:41:06","date_gmt":"2021-07-26T16:41:06","guid":{"rendered":"https:\/\/focusgn.com\/asia-pacific\/?p=20661"},"modified":"2026-04-23T17:14:45","modified_gmt":"2026-04-23T20:14:45","slug":"philippines-pogos-tax-to-be-approved-with-minor-changes","status":"publish","type":"post","link":"https:\/\/focusgn.com\/asia-pacific\/philippines-pogos-tax-to-be-approved-with-minor-changes","title":{"rendered":"Philippines: POGOs tax to be approved with minor changes"},"content":{"rendered":"\n<p>The new bill that sets income and gaming taxes for online casinos operated from the Philippines will be approved by The House of Representatives.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p>The Philippines.- The bill under which\u00a0<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/focusgn.com\/asia-pacific\/the-philippines-urges-quick-approval-of-new-pogos-tax\">Philippine offshore gaming operators (POGO)<\/a>\u00a0must pay<strong>\u00a05 per cent tax on their gross gaming revenue\u00a0<\/strong>looks set to be approved with minor changes.<\/p>\n\n\n\n<p>According to the Department of Finance, one of the changes\u00a0will <strong>require all foreign POGO employees to have a tax identification number<\/strong>. The other change prevents the Aurora Pacific Economic Zone and Freeport from issuing new POGO licences.<\/p>\n\n\n\n<p>Under the new bill, those licences that are currently registered will be under the purview of PAGCOR. <\/p>\n\n\n\n<p>The bill states that POGOs will have to pay 5 per cent on gross gaming revenue. <strong>Foreigners employed in online casinos and their service providers must pay 25 per cent income tax<\/strong>.\u00a0<\/p>\n\n\n\n<p><a target=\"_blank\" href=\"https:\/\/focusgn.com\/asia-pacific\/pogo-tax-payments-rise-11-7-in-2020\" rel=\"noreferrer noopener\">POGOs<\/a>&nbsp;brought in&nbsp;<strong>US$149.4m in tax payments last year<\/strong>&nbsp;despite the impact of the Covid-19 pandemic and the resulting departure of many firms.<\/p>\n\n\n\n<p>However, <strong>House Ways and Means Committee <\/strong>believes that under the new bill, the government could collect PHP13.4bn (US$266.6m) in its first year of implementation.<\/p>\n\n\n\n<p>Last year, the Philippines\u2019 lower chamber\u00a0<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/focusgn.com\/asia-pacific\/the-philippines-online-gaming-tax-bill-advances\">tried to impose a 5 per cent franchise tax on overall turnover<\/a>\u00a0for POGOs, but online gambling operators began leaving the country. The<strong>\u00a0tax changes\u00a0<\/strong>were finally\u00a0<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/focusgn.com\/asia-pacific\/supreme-court-suspends-5-pogo-tax\">suspended in January<\/a><strong>\u00a0<\/strong>following a petition to the Supreme Court from foreign gaming groups, but<strong>\u00a0<\/strong>they were<strong>\u00a0<\/strong><a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/focusgn.com\/asia-pacific\/the-philippines-online-gaming-tax-bill-advances\">reintroduced in February<\/a>.<\/p>\n\n\n\n<p>According to PAGCOR\u2019s website, the<strong>&nbsp;number of POGO licence holders that are currently operating is just 40<\/strong>, compared with 61 before the Covid crisis.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>POGOs are returning to the Philippines<\/strong><\/h2>\n\n\n\n<p>Last year, three operators in Manila were granted licences for local <a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/focusgn.com\/asia-pacific\/philippines-operators-get-online-casino-licences\">online casino platforms<\/a>. <\/p>\n\n\n\n<p>The Philippine president, Rodrigo Duterte, has said that he allowed\u00a0<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/focusgn.com\/asia-pacific\/philippines-online-gambling-necessary-to-boost-economy\">online gambling<\/a>\u00a0because the country needs money to recover from the Covid-19 pandemic.<\/p>\n\n\n\n<p>According to the Philippine News Agency, Duterte said: \u201cWe don\u2019t have money\u2026 Now that we need money,&nbsp;<strong>the most sensible thing is really just to encourage those activities<\/strong>.\u201d<\/p>\n\n\n\n<p>The possibility of&nbsp;<a target=\"_blank\" href=\"https:\/\/focusgn.com\/asia-pacific\/new-boracay-development-authority-could-allow-casinos\" rel=\"noreferrer noopener\">casino gaming on Boracay island<\/a><strong>&nbsp;<\/strong>has resurfaced in recent weeks after the House of Representatives approved the creation of the<strong>&nbsp;Boracay Island Development Authority<\/strong>&nbsp;as a government-owned and controlled corporation (GOCC).<\/p>\n\n\n\n<p>However, the bill was<strong>&nbsp;highly criticised by government agencies<\/strong>, local government units, stakeholders and some congressmen who want to protect the island\u2019s environment.<\/p>\n\n\n\n<p><strong>Natividad Bernardino<\/strong>, chairman of the Boracay Inter-Agency Rehabilitation Management Group, said: \u201cThe problem of Boracay is one of over-tourism and overdevelopment.&nbsp;<\/p>\n\n\n\n<p>\u201cWhat we need in terms of sustaining the rehabilitation and ecological sustainability of the island is&nbsp;<strong>a regulatory body instead of a GOCC<\/strong>.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The new bill that sets income and gaming taxes for online casinos operated from the Philippines will be approved by The House of Representatives.<\/p>\n","protected":false},"author":176,"featured_media":20663,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"is_press_release":false,"is_interview":false,"is_opinion":false,"focusai_summary":"The Philippine House of Representatives is poised to approve a bill imposing a 5% GGR tax on Philippine Offshore Gaming Operators (POGOs) and a 25% income tax on foreign employees, alongside restricting new licenses from the Aurora Pacific Economic Zone and consolidating existing licenses under PAGCOR.
