According to <strong>Judge Robin Mossop<\/strong>, who delivered the ruling, bets placed without actual financial risk are invalid.<\/p>\n\n\n\n<p>The case centres on a fast-paced game titled &#8220;<strong>Betgames Instant Lucky 7\u201d <\/strong>offered by Hollywood Sportsbook KwaZulu-Natal (Pty) Ltd. The title mimics aspects of the national lottery but features draws every 30 seconds, allowing for rapid betting.<\/p>\n\n\n\n<p>Between <strong>December 22 and 31, 2023<\/strong>, a system error prevented the deduction of stakes from players&#8217; accounts, enabling them to place wagers and collect payouts without any real monetary loss. Gamblers quickly noticed the flaw and exploited it, leading to collective winnings exceeding R13 million (\u20ac634,458), with individual amounts ranging from R3,000 (\u20ac146) upward.<\/p>\n\n\n\n<p>One respondent, <strong>Nsikayesizwe Thobelani Gcabashe<\/strong>, detailed in court documents how he deposited <strong>R50<\/strong> (\u20ac2.44) on <strong>December 28 <\/strong>and <strong>R850<\/strong> (\u20ac41.48) the next day, then placed around 40 bets over four days, ultimately winning <strong>R443,700<\/strong> (\u20ac21,659). He withdrew the funds and transferred them to his personal bank account, believing the winnings were legitimate.<\/p>\n\n\n\n<p>Hollywood Sportsbook detected the anomaly through its monitoring systems and attributed the glitch to an error by an outsourced developer. The company promptly removed the game and contacted the winners, requesting voluntary repayment. When most refused, citing adherence to the platform&#8217;s rules, Hollywood initiated legal proceedings to recover the funds.<\/p>\n\n\n\n<p>The court battle began with a temporary order on <strong>January 5, 2024,<\/strong> issued by Judge Jacqueline Henriques, which led to the freezing of the gamblers&#8217; bank accounts at several banking institutions, including Capitec, Absa, African Bank, Discovery and Nedbank.<\/p>\n\n\n\n<p>The matter culminated this week, with Judge Mossop ruling that the company&#8217;s claim was consistent and justified. He said: \u201cThe respondents gambled for free. The wagers placed by the respondents through the impugned game were not valid. It must follow, therefore, that the respondents were not entitled to the winnings that they received from the impugned game and that they must be returned to the applicant.&#8221;<\/p>\n\n\n\n<p>However, the judge dismissed allegations of fraud or conspiracy among the gamblers, noting that they were scattered across KwaZulu-Natal and other parts of South Africa with no evident connections. On the other hand, he determined that the players had exploited a clear weakness in the system.<\/p>\n\n\n\n<p>Judge Mossop further observed that the gamblers&#8217; affidavits followed a uniform template, differing only in the sums won, and that some may have shared news of the glitch with others who couldn&#8217;t access it.<\/p>\n\n\n\n<p>The gamblers argued they had done nothing wrong, having used their own deposited funds and followed the game&#8217;s protocols. Yet the court found this unpersuasive, ruling the bets invalid due to the absence of genuine risk: a core element of gambling contracts under South African law.<\/p>\n\n\n\n<p>The ruling, if upheld, would require the gamblers to forfeit substantial windfalls, compounding their financial woes from missed payments and damaged credit due to frozen accounts.
