Gambling operators and sportsbooks were given until the end of March 2025 to submit documentation proving that these types of gambling games met the board’s stringent standards for fairness, transparency and consumer protection.

However, with the deadline now expired, uncertainty looms over the industry as the BCLB remains tight-lipped on compliance levels and potential repercussions for non-conforming operators.

In mid-March, the BCLB mandated that operators provide comprehensive documentation within 14 days of its directive. The required submissions included detailed explanations of game mechanics, fully disclosed algorithms certified by independent auditors and information about the game providers.

The instruction to all licensed gaming operators demanded full disclosure and a regulatory review of crash games like Aviator, Skyward and Jet X. It also gave the operators seven days to submit a comprehensive list of these games for audit. These included certificates from recognised gaming developers. It is not yet clear how many operators had submitted this.

“This directive is in response to growing public concerns about the mechanics of Aviator and crash games,” the BCLB stated in an official communication.

The board also went a step further and banned standalone crash game applications, stating that these had to be integrated into sportsbook and online casino platforms. Non-compliance could lead to severe penalties under Kenya’s Betting, Lotteries and Gaming Act Cap. 131, including suspension or revocation of operating licenses.

Tightening the Reins on Compliance

Crash games have grown exponentially in popularity across the world and in Africa over the past year. Many regulators consider these ‘high-risk’ games with the potential for unfair practices. According to the Board, the new measures seek to reinforce consumer protection and ensure regulatory transparency.

Among other documents, operators needed to submit:

Names, certificates, and contract details of third-party accredited game providers.

Approved payment accounts for crash gambling transactions.

A full outline of game mechanics, payout processes as well as betting processes.

Complete disclosure of game algorithms certified by independent auditors.

Player-facing terms and conditions including disclaimers, liability clauses and betting limits.

Proof of integration of crash games into sportsbook or online casino platforms.

Regulatory Hammer Poised for Non-Compliance

The Board said that non-compliance would not be tolerated. Any operator found offering unapproved crash games would face prosecution.

“Strict adherence to this directive is mandatory. Any game failing to meet the requisite standards and certifications will not be approved,” the Board said.

With the regulator ramping up enforcement, Kenya’s gaming industry faces a pivotal moment in one of Africa’s fastest-growing betting markets.

Two-week deadline set by the Betting Control and Licensing Board (BCLB) for a full compliance review of crash games has officially passed.
