{"id":3164,"date":"2025-05-22T03:22:38","date_gmt":"2025-05-22T06:22:38","guid":{"rendered":"https:\/\/focusgn.com\/africa\/?p=3164"},"modified":"2026-04-19T16:51:16","modified_gmt":"2026-04-19T19:51:16","slug":"gambling-houses-must-pay-levies-rules-high-court-in-namibia","status":"publish","type":"post","link":"https:\/\/focusgn.com\/africa\/gambling-houses-must-pay-levies-rules-high-court-in-namibia","title":{"rendered":"Gambling houses must pay levies, rules High Court in Namibia"},"content":{"rendered":"\n<p>Judge rules against Gambling House Association&#8217;s bid to dodge levies amid illegal gambling crisis.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p>Namibia.- <strong>Namibia&#8217;s High Court<\/strong> has dealt a heavy blow to the <strong>Gambling House Association of Namibia (GHAN)<\/strong>, ruling that licensed gambling operators must pay levies on their profits, as required by law.<\/p>\n\n\n\n<p>In a firm judgement handed down by<strong> Judge Nate Ndauendapo<\/strong>, the court ordered GHAN and its members to comply with the <strong>Gaming and Entertainment Control Act of 2018,<\/strong> specifically, the clause that mandates a 10 per cent levy on profits from gambling operations. The ruling applies retrospectively from December 2021 and includes interest.<\/p>\n\n\n\n<p>GHAN had attempted to wriggle free of the obligation, arguing that no levies should be imposed until all illegal gambling houses in Namibia had either been legalised or shut down.<\/p>\n\n\n\n<p>They also challenged the constitutionality of the 2018 Act, claiming it gave the Minister of Environment and Tourism too much discretionary power. Both arguments were shot down in court.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Moratorium on levies<\/h2>\n\n\n\n<p>In a desperate legal gamble, GHAN leaned on a 2020 High Court settlement agreement, which had placed a moratorium on levies until illegal operators were dealt with.
