Kenya.- Kenya has introduced new gambling regulations that would allow family members to request the suspension of betting accounts belonging to people believed to be suffering from gambling addiction.<\/p>\n\n\n\n

The proposal is contained in the draft Gambling Control (Conduct of Gambling Operations) Regulations, 2026, published by the Gambling Regulatory Authority (GRA)<\/strong> for public participation under the Gambling Control Act, 2025<\/strong>.<\/p>\n\n\n\n

Under the draft regulations, relatives and other third parties would be able to petition the GRA to prohibit a person from accessing licensed gambling services where there is evidence that the individual has developed a gambling disorder or is displaying harmful gambling behaviour.<\/p>\n\n\n\n

The proposal forms part of broader responsible gambling measures that also introduce a formal self-exclusion programme. Under the framework, players who believe they have developed a gambling problem would be able to voluntarily suspend access to their betting accounts through agreements with licensed gambling operators for a specified period.<\/p>\n\n\n\n

The regulations would also require operators to play a more active role in identifying problem gambling. Licensees would be expected to monitor customer activity and suspend accounts where betting patterns or financial transactions indicate severe financial distress or where continued gambling could pose a risk to public safety.<\/p>\n\n\n\n

To support these measures, the GRA plans to establish a central monitoring system that would track gambling activity across licensed platforms. The system would analyse player behaviour for signs of gambling harm, recommend account suspensions where necessary and facilitate referrals for counselling and treatment services.<\/p>\n\n\n\n

Beyond responsible gambling, the draft regulations introduce new data protection requirements for gambling operators. Applicants seeking licences would be required to submit privacy policies, privacy statements, data protection certificates and related documentation, while licensed operators would need to encrypt customer data during storage and transmission and maintain records for regulatory inspection.<\/p>\n\n\n\n

Operators would also be prohibited from publicly identifying prize winners unless the individual gives written consent or disclosure is required by law or a court order.<\/p>\n\n\n\n

The Conduct of Gambling Operations Regulations are one of six sets of draft frameworks issued under the Gambling Control Act, 2025. The wider package covers licensing, advertising, foreign gambling operators, national lottery operations and appeals procedures.<\/p>\n\n\n\n
