The National Transitional Council (CNT) has condemned ARSJPA\u2019s directive to gambling operators, highlighting legal violations.<\/p>\n\n\n\n\n\n\n\n
Guinea.- The National Transitional Council <\/strong>(CNT) of Guinea<\/strong> has publicly condemned a letter from the Director General of the Gaming and Related Practices Regulatory Authority<\/strong> (ARSJPA), describing it as \u201cinadmissible<\/strong>\u201d. The letter, dated February 4, 2025 (Letter No.\u202f0024\/ARSJPA\/DG\/2025), instructed gambling operators not to pay legally mandated taxes<\/strong>, triggering a strong backlash from the country\u2019s legislative body in November 2025.<\/p>\n\n\n\n The CNT, Guinea\u2019s temporary legislative body during the transitional period, acts like a parliament<\/strong>, reviewing laws<\/strong>, overseeing government agencies<\/strong> and monitoring compliance in key sectors such as gaming. Its oversight powers became particularly important during the review of Guinea\u2019s 2025 supplementary<\/strong> budget law.<\/p>\n\n\n\n During this review, the CNT emphasised the application of the two categories of levies established under the Initial Finance Law 2025: a 15 per cent<\/strong> tax on gross gaming revenue and a 7 per cent<\/strong> levy on Non-Commercial Profits (BNC) for winnings exceeding GNF1m (\u20ac90).<\/p>\n\n\n\n The Council claims that ARSJPA instructed operators \u201cto refuse to pay these legally established<\/strong> taxes”, according to a Guinee114.com report.<\/p>\n\n\n\n CNT said: “In other words, an administrative service<\/strong> opposed the application of a law duly proposed by the Government, adopted by Parliament and promulgated by the President of the Republic, without any legal basis whatsoever.\u201d<\/p>\n\n\n\n The Council described ARSJPA\u2019s actions as contravening \u201cthe principle<\/strong> of the hierarchy of norms and the obligation<\/strong> of all state bodies to respect the law.\u201d The Council called on the Prime Minister<\/strong> to ensure these tax measures are implemented in accordance with the Finance Law.<\/p>\n\n\n\n CNT also highlighted a legal inconsistency<\/strong> concerning ARSJPA\u2019s status. While Law 08 of March 13, 2023, establishes the authority as an Independent Administrative Authority (AAI), Decree 045 of January 28, 2023, grants it the status of a public administrative body, creating a conflict<\/strong> between statutory law and executive decree. The CNT recommended repealing<\/strong> the decree<\/strong> and aligning ARSJPA\u2019s framework with Law 08.<\/p>\n\n\nCNT rebukes ARSJPA for defying tax law<\/h2>\n\n\n\n
