They emphasise that the decision affects only Gauteng-licensed operators and that betting remains <strong>fully legal<\/strong> in other provinces.<\/p>\n\n\n\n<p>Gambling law specialists <strong>Garron Whitesman <\/strong>of Whitesmans Attorneys and <strong>Wayne Lurie<\/strong> of Lurie Inc Attorneys, both members of the<strong> South African Responsible Online Gambling Association<\/strong> (SAROGA), clarified that the SCA judgment applies solely to Gauteng\u2019s <strong>provincial framework<\/strong>. The decision is <strong>legally binding<\/strong> in Gauteng but does not automatically extend to other provinces, which operate under <strong>separate gambling legislation<\/strong>, according to these experts.<\/p>\n\n\n\n<p>The clarification comes after confusion in the industry following the SCA\u2019s October 2025 ruling in the <strong>Supabets\/CASA<\/strong> case. While the court confirmed that Gauteng-licensed bookmakers cannot offer <strong>roulette<\/strong> and similar casino-style games, legal experts stress that operators in other provinces may continue offering online betting, provided they <strong>comply<\/strong> with their respective provincial laws.<\/p>\n\n\n\n<p>Whitesman explained that the ruling should not be seen as a national ban. \u201cResidents of every province in South Africa may <strong>lawfully<\/strong> place bets on casino style <strong>contingencies<\/strong> with bookmakers licensed in any province in South Africa,\u201d he said, according to Polity.org.za.<\/p>\n\n\n\n<p>He added: \u201cThe recent SCA judgment was <strong>limited<\/strong> to the Gauteng Gambling Act and the licences issued under it. It does not prohibit <strong>provincially licensed<\/strong> bookmakers elsewhere in South Africa from offering fixed odds bets on live casino style games, provided they comply with their own provincial laws.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Second expert affirms online betting remains legal<\/strong><\/h2>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"595\" height=\"595\" src=\"https:\/\/focusgn.com\/africa\/wp-content\/uploads\/sites\/7\/2025\/11\/WAYNE-LURIE.jpg\" alt=\"\" class=\"wp-image-12586\" \/><figcaption class=\"wp-element-caption\">Legal specialist Wayne Lurie confirms that online betting remains fully legal for players outside Gauteng.<\/figcaption><\/figure>\n\n\n\n<p>Lurie reinforced Whitesman\u2019s view that online betting remains legal outside Gauteng. \u201cThe SCA interpreted one provincial law; it did not read down the <strong>National Act<\/strong> or the laws of other provinces. Nor did it find that accepting bets through an online platform is itself unlawful. Its concern was the subject of those bets &#8211; roulette &#8211; not the <strong>medium<\/strong> through which bets are placed,\u201d he said, according to IOL.<\/p>\n\n\n\n<p>The <strong>controversy<\/strong> stems from an NGB statement on October 30, published by IOL in an article titled \u201cSCA judgment tightens online gambling rules, bans bookmakers from offering roulette and casino gaming\u201d.<\/p>\n\n\n\n<p>In that report, the NGB said: \u201cIt is <strong>unlawful<\/strong> for bookmakers to offer fixed-odds bets on the outcome of a casino game, including the game of roulette, under the <strong>Gauteng Gambling Act of 1995.<\/strong>\u201d The Board added that the ruling \u201cextends to all bookmakers across the country\u201d.<\/p>\n\n\n\n<p>The legal experts argue that the SCA judgment merely clarifies the provincial framework rather than <strong>rewriting<\/strong> national gambling law.
